Presidente do Tribunal Superior Eleitoral (TSE), Alexandre de Moraes
O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), votou nesta sexta-feira (8), pela primeira vez, pela absolvição de um dos réus pelos atos golpistas de 8 de janeiro do ano passado, quando as sedes dos Três Poderes foram invadidas e depredadas, em Brasília.
Moraes seguiu parecer da Procuradoria-Geral da República (PGR) que, após a instrução da ação penal, mudou o entendimento em relação à denúncia e opinou pela absolvição de Geraldo Filipe da Silva, preso no dia dos atos perto do Congresso Nacional.
A defesa do réu alegou que ele é um morador de rua que se viu cercado pelos vândalos, mas que não participou de atos violentos.
Vídeos da prisão em flagrante do réu mostram que ele foi agredido pelos vândalos, sendo acusado de “petista” e “infiltrado”, responsável por vandalizar viaturas para tumultuar a manifestação. As investigações não foram capazes de demonstrar que ele, de fato, praticou atos violentos.
Na decisão, Moraes diz que “não há elementos probatórios suficientes que permitam afirmar que o denunciado uniu-se à massa, aderindo dolosamente aos seus objetivos, com intento de tomada do poder e destruição do Palácio do Planalto, do Congresso Nacional e do Supremo Tribunal Federal”.
O caso é julgado no plenário virtual, em que os votos dos ministros são registrados no sistema do Supremo, sem deliberação presencial. Moraes foi o único a votar até o momento. A sessão de julgamento começou hoje (8) e segue até a próxima sexta (15).
Outros 14 réus são também julgados a partir desta sexta. Em relação a esses, Moraes votou pela condenação, com penas que variam de 11 a 17 anos de prisão.
Todos foram denunciados pela PGR por cinco crimes: abolição violenta do Estado Democrático de Direito, golpe de Estado, dano qualificado, deterioração de patrimônio tombado e associação criminosa.
